Terms of Use – DarStays

1. Introduction:

1.1 This electronic platform “DarStays” or the website of Dar, hereinafter referred to as: “DarStays Website” or “the Website” or “the Platform” or “Dar” or “the App” or “DarStays,” is available for your personal or business use. Your access, registration, and use of the Website are subject to these Terms of Use and the laws of the Kingdom of Saudi Arabia.
1.2 Your access and entry to the Platform constitute unconditional acceptance of the Terms of Use, effective from the date of your registration.
1.3 The use of the Platform includes several terms and conditions subject to continuous updates and changes as needed. Any amendment or update to these terms becomes effective immediately upon approval by DarStays management. Therefore, you must regularly review the Terms of Use and the Disclaimer Principles to stay informed of any updates, as your continued use of the Platform constitutes your full awareness and acceptance of any modifications made.
1.4 DarStays management is not obligated to announce any updates to these terms.
1.5 These Terms of Use represent a legally binding agreement between you and DarStays governing the right to use the website, applications, and other offerings by DarStays.
1.6 DarStays allows users (“guests” or “clients”) to search for, book, and use accommodations and services. It also allows “unit lessors or hosts” to list accommodations and provide services. Each purpose of a host’s service is referred to as a “Host Listing.” DarStays does not own, control, provide, or manage any of the Host Listings or hosting services.
1.7 DarStays provides additional terms and policies that complement these terms, such as the Privacy Policy explaining how personal data is collected and used, and the Payment Terms referred to in these conditions, which govern any payment services provided by DarStays entities and payment operations to hosts.

2. Terms Applicable to Guests:

2.1 Searching for Accommodations
Guests can search for accommodations using criteria such as type of housing, city, and stay dates, and can use filters to refine search results. However, DarStays does not guarantee the compatibility between search data and results, and it is the guest’s responsibility to carefully verify the search results.

2.2 Booking Terms
When completing a booking through DarStays, you agree to all booking terms imposed by the host, including policies on booking changes or cancellations, no-shows, check-in and check-out times, and any other conditions imposed during the stay or booking, including available services and/or products provided at the accommodation.
Upon receiving the booking confirmation and completing the booking, you agree to all booking terms. The host’s change or cancellation policy and any other rules, standards, or requirements specified in the host’s listing or during the payment process govern the relationship between the guest and the host. It is the guest’s responsibility to read and understand all these terms before booking.
Guests may cancel or modify their bookings through the application unless restricted by the host’s policy.
If you arrive later than the specified check-in time, you must contact the host directly to inform them.
If you cannot check in to the accommodation for reasons attributable to you, the booking amount will be non-refundable unless otherwise stated in the host’s terms.
In case of cancellation, the refund amount will be determined according to the host’s change or cancellation policy.

2.3 Booking Change or Cancellation Policies
Strict: No refund is allowed after the guest confirms the booking.
Moderate: The guest is entitled to cancel and receive a full refund if cancellation occurs at least 4 days (96 hours) before the scheduled check-in date and time.
Flexible: The guest is entitled to cancel and receive a full refund if cancellation occurs at least 2 days (48 hours) before the scheduled check-in date and time.
Free: The guest is entitled to cancel and receive a full refund if cancellation occurs at least 1 day (24 hours) before the scheduled check-in date and time.

2.4 Booking Cancellation
The guest is required to pay the deposit (if any) or the full booking amount upon confirmation.
Certain bookings with specific rates or special offers may be non-changeable or non-cancellable.
Accommodations may impose additional fees for late check-out or early check-in as per the host’s terms.
Before booking, please review the host’s terms, change or cancellation policy, and the no-show policy listed on the property’s page before completing your booking. If the guest fails to check out at the scheduled time, the platform and host have the right to deduct the full nightly rate for the late stay.
If you wish to view, modify, or cancel your booking, please visit the “My Bookings” section in the app or contact customer service.

2.5 Guest Compensation
At the sole discretion of DarStays, compensation may be provided to the guest in the following cases:
The booked unit is unfit for use.
Essential advertised facilities are missing or non-functional.
The booked unit is not clean according to common standards.
The host unjustifiably refuses to deliver the booked unit.
The report must be submitted within two hours of check-in time, and compensation shall not exceed the amount paid by the guest under any circumstances.


2.6 Disclaimer:
The user acknowledges that the use of accommodations listed on the platform is strictly for lawful and legitimate purposes and bears full legal responsibility for any actions or uses that violate laws, public morals, or involve prohibited activities, immoral conduct, or any acts punishable by law within or related to the unit.
The platform, its owners, representatives, partners, and employees shall bear no direct, indirect, or consequential liability arising from any unlawful use that results in legal or ethical accountability, and the platform operator shall be exempt from any obligations, claims, or damages resulting from such actions.
The platform reserves the right to provide official or competent authorities with any information or data related to the user, booking, or unit usage upon request in accordance with applicable laws in the Kingdom.
The platform does not guarantee the availability of any pre-requested internal facilities.
It is advised to run antivirus programs on any materials downloaded from the platform.
The platform is used entirely at your own risk, and under no circumstances shall the platform be liable for any loss or damage of any kind arising from your use or visit to the site, reliance on any content, statement, or advertisement posted on it, or any delay, interruption, or connection failure, technical malfunction of hardware or software, or any acts, statements, or ideas made by any person using the platform.
The platform is not liable for damages caused by natural disasters, dealings with the host or other parties, loss or damage to property, or any physical injuries that may occur to the guest or others.
Accordingly, you agree that your sole and exclusive remedy for any loss or damage resulting from your access or use of this platform is to discontinue its use.
DarStays employs all means to ensure the site and app are operational and services are available but cannot guarantee uninterrupted operation.
DarStays is not responsible for loss, damage, or theft of personal belongings, nor for the safety of the booked unit or any injuries to the guest, including but not limited to drowning or other incidents.

3. General Provisions:
3.1 After the booking period ends, guests and hosts may rate each other accurately, refraining from using offensive, defamatory, or discriminatory language.
3.2 The user must be at least 18 years old and legally capable of entering into binding agreements.
3.3 The host has the right to hand over the unit only to the booking holder, as verified by ID, mobile number, and email.
3.4 Fake or speculative bookings are prohibited, and the platform may cancel violating bookings.
3.5 Tampering with the site interface or performing actions that place a disproportionate load on infrastructure is prohibited.
3.6 Full and timely payment of all due amounts is required.
3.7 You must fully comply with all platform terms and conditions, including but not limited to timely payment of all dues and adherence to all rules related to the availability of prices, products, services, and fees.
You must also refrain from any act that may cause harm, interfere with, or disrupt access to the platform or its content, or upload any files or programs containing viruses, code, or software aimed at intercepting or destroying data or limiting site functionality.
It is prohibited to post, distribute, or upload any defamatory, offensive, infringing, harmful, threatening, insulting, racist, immoral, or illegal material of any kind, or send spam, advertisements, or any form of unauthorized mass communications.
It is also prohibited to threaten, harass, or abuse others, violate their rights or privacy, attempt unauthorized access to the site or other users’ accounts, impersonate others, or misrepresent identity.
3.8 Any act that violates or harms the intellectual property rights of the platform, its affiliates, or third parties is prohibited, as well as any illegal activity that may create liability toward DarStays.
It is also prohibited to violate this agreement or any applicable law, upload or attach files protected by intellectual property rights without authorization, or upload files containing viruses, malware, or corrupted data that may affect other users’ devices.
3.9 Removing or altering copyright notices, legal marks, or proprietary labels from uploaded files is prohibited, as is falsifying the source or origin of materials or software. It is also prohibited to advertise, offer for sale, organize contests or surveys, send chain letters, or upload promotional materials without authorization.
3.10 The site or app and its content must not be used for any purpose other than their intended use. Accessing, monitoring, or copying any content manually or electronically without prior written consent is prohibited, as is bypassing or attempting to bypass security measures protecting the site. Any act that imposes an excessive or disproportionate load on the platform’s infrastructure is prohibited, as well as deep linking to any part of the site or incorporating any part of it into another website without written approval from the platform management.
3.11 The governing law is Saudi law, and the courts of Jeddah shall have jurisdiction over any legal disputes that may arise.

4. Violation of Terms:
If the platform determines that a user has violated any clause, it reserves the right to:
Warn the user and request immediate cessation of the violating behavior.
Delete any materials or content without prior notice.
Take measures including suspension, restriction, or cancellation of access and bookings.
Report to competent authorities.
Take legal action and claim compensation.

5. Copyrights and Trademarks:
5.1 All app and platform content is subject to copyright.
5.2 All trademarks of DarStays and partner companies are owned by their respective owners.
5.3 The app is available for personal use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, create derivative works from, transfer, or sell any information, software, products, or services obtained from the site.

6. Compensation and Legal Liability:
6.1 The user agrees to indemnify the platform for any liabilities, losses, claims, or expenses arising from their use of the app.
6.2 If the guest causes damages to the unit, they must compensate the platform for the host’s security and safety deposit amount.
6.3 The platform shall assess the compensation amount and provide details upon request.
6.4 The guest must pay the compensation amount through the link sent by DarStays within the period specified in the text message. If the platform does not receive payment, the guest’s wallet balance will be negative, and no new bookings will be accepted until the compensation is paid. DarStays reserves the right to pursue the guest legally to recover such amounts in accordance with these terms and conditions.
6.5 In addition to other compensations specified herein, as a condition of using the app, you agree to indemnify us against all liabilities, losses, claims, expenses (including legal costs), and damages (direct or indirect) arising from claims related to your app usage, including any disputes proven valid and constituting a breach of this agreement by you.

7. Final Provisions:
7.1 The guest must provide accurate data including passport/residency/national ID, email address, mobile number, and date of birth.
7.2 The guest and host agree to receive communications from DarStays via email, app notifications, and SMS messages. These include promotional messages, service offers, and booking details.
7.3 If the host requires a security deposit, the guest must pay it upon arrival and before receiving the booked unit, according to the host’s conditions. If the guest returns the property in good condition, the host must refund the deposit after verifying the unit’s condition and before the next scheduled check-in. The guest waives the deposit amount in case of property damage, and DarStays bears no legal or ethical responsibility regarding the deposit, as it is exchanged directly between guest and host without DarStays’ involvement.
7.4 In case of violation of booking terms or damage, the host has the right to request guest data for submission to authorities, and the platform disclaims responsibility for its accuracy.
7.5 The scheduled check-in time is the time set by the host for unit handover.
